presumably a young bird in its first breeding season, with incomplete transition to its breeding plumage. I am assuming that a non-breeding male (another possible explanation for the incomplete breeding plumage) would not be singing.

in the white mulberries

back color indicates incomplete transition to breeding plumage. May be a non-breeding male or a young first-breeding-season bird that has not completed full transition to breeding plumage.

the male of the resident pair perched on a branch about 8 feet from the nest. He appears to be looking directly at the nest. Shortly after this photo the female left the nest and the male took her place. She was gone 12 minutes then returned, resumed incubating and this bird left the immediate area.
